These Terms & Conditions (“Terms”) govern your use of www.totalbodyaesthetic.com and related online features operated by Total Body Management, the owner and management company of Total Body Aesthetic. By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Informational and Medical Disclaimer

Website content is provided for general educational and promotional purposes. It is not medical advice, diagnosis, treatment, or a substitute for an evaluation by a qualified licensed professional. Using the Website, sending a form, or making a purchase does not by itself create a provider-patient relationship. If you believe you have a medical emergency, call 911 or seek immediate medical care.

2. Eligibility and Acceptable Use

You must be legally able to enter a binding agreement and provide accurate, current information. You may not misuse the Website; interfere with its security or operation; attempt unauthorized access; introduce harmful code; scrape or copy content through automated means without permission; impersonate another person; or use the Website unlawfully.

3. Appointments, Services, and Results

Appointment requests are not confirmed until accepted by Total Body Aesthetic. Services remain subject to provider availability, consultation, informed consent, clinical judgment, and medical candidacy. Descriptions, before-and-after materials, and testimonials do not promise a particular result. Individual results, recovery, risks, and duration vary. No permanent result or outcome is guaranteed.

4. Pricing, Purchases, and Promotions

Prices and promotions may change before purchase and may have stated eligibility, quantity, timing, expiration, or combination restrictions. You authorize charges you approve at checkout and represent that you are authorized to use the payment method. Online checkout may be provided by Stripe. Financing through Cherry, CareCredit, or another third party is separately governed by that provider’s terms.

Purchases are final sale except where a refund or other remedy is required by applicable law. Additional details appear in our Purchase and Final Sale Policy, which is incorporated into these Terms.

5. Communications

By submitting contact information, you authorize us to respond about your inquiry, appointment, or transaction. Marketing email may be unsubscribed through the message. Text marketing is sent only with the consent presented at signup; consent is not a condition of purchase. Message frequency varies, message and data rates may apply, and you may reply STOP to opt out or HELP for help.

6. Intellectual Property and User Submissions

The Website and its text, design, logos, graphics, photographs, video, and software are owned by or licensed to Total Body Aesthetic and protected by applicable law. You may use the Website only for personal, noncommercial purposes. If you submit a review, testimonial, image, or other content for publication, you represent that you have the right to do so. Any broader marketing permission should be documented in a separate written authorization where required.

7. Third-Party Services and Links

The Website may link to or embed Stripe, Cherry, CareCredit, Google Maps, social networks, or other third-party services. We do not control their availability, content, terms, privacy practices, lending decisions, or services. A link is not a warranty or endorsement.

8. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the Website is provided “as is” and “as available,” without warranties of uninterrupted access, error-free content, or fitness for a particular purpose. To the fullest extent permitted by law, Total Body Aesthetic will not be liable for indirect, incidental, special, consequential, or punitive damages arising from Website use. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

9. Governing Law and Changes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, subject to rights that applicable consumer law does not permit you to waive. We may update these Terms by posting a revised version and effective date. If a provision is unenforceable, the remaining provisions remain in effect.
